Its sensitivity is substantially lower than CT and is highly operator-dependent, but a positive ultrasound — visualization of a non-compressible appendix exceeding 6 mm in diameter with periappendiceal echogenicity — is sufficient to proceed to surgical consultation without additional imaging. A negative or non-diagnostic ultrasound in a symptomatic patient does not exclude appendicitis and should prompt CT or close clinical monitoring with explicit return-precautions documentation.
The most common documentation failure in missed appendicitis cases is straightforward: a patient presents with right lower quadrant pain, tenderness, anorexia, and an elevated white count, and the emergency physician discharges that patient with a diagnosis of constipation, gas pains, or nonspecific abdominal pain without CT imaging. When the same patient returns 24 to 48 hours later with a perforated appendix and peritonitis, the imaging that was not ordered at the first visit becomes the centerpiece of the liability analysis.
Patterns of Negligence in Appendicitis Cases
Atypical presentations in high-risk populations. Appendicitis does not always present with classic right lower quadrant migration and peritoneal signs. In elderly patients, immunocompromised individuals, and patients in the third trimester of pregnancy — in whom the gravid uterus displaces the appendix superiorly — the presentation may be muted, diffuse, or localized to an unexpected abdominal quadrant. Inadequate return precautions and follow-up. Even when the initial evaluation is reasonable and discharge is appropriate for a patient with a low Alvarado score and negative imaging, failure to provide clear, documented return precautions — specifying which symptoms should prompt immediate return, and within what timeframe — can constitute a separate deviation. Appendicitis may be early and evolving at a single visit, and explicit return instructions are a recognized component of responsible disposition.
Establishing Causation in Appendicitis Malpractice Cases
Causation in appendicitis cases rests on the demonstrable relationship between diagnostic delay and perforation. The transition from uncomplicated to perforated appendicitis is the key causation event, because it is at perforation that the injury escalates from a straightforward laparoscopic procedure to a substantially more morbid and complicated clinical course.
Timeline reconstruction. The expert reconstructs the documented clinical course: symptom onset, time of first evaluation, findings recorded at that visit, the decision to discharge, and the time of return with confirmed perforation. When the first evaluation documents an elevated white count, right lower quadrant tenderness, and anorexia — findings that should have triggered CT imaging under the standard of care — the expert can opine that the appendicitis was present and recognizable at the first visit, and that prompt imaging and surgical consultation at that point would more likely than not have resulted in an uncomplicated appendectomy.
Stage-shift analysis. Published outcomes data on uncomplicated versus perforated appendicitis allow the expert to describe specifically what the plaintiff lost through the delay. Perforated appendicitis carries substantially higher rates of surgical site infection, intra-abdominal abscess, prolonged hospitalization, readmission, and, in the most severe cases, feculent peritonitis with septic shock requiring intensive care. A plaintiff who required extended hospitalization, multiple surgical procedures for abscess drainage, and a prolonged recovery following a perforated appendicitis diagnosis — when the presenting evaluation days earlier documented the signs of early appendicitis and ordered no imaging — presents a causation framework that is concrete and documentable from the medical record.
Daubert Considerations for Appendicitis Expert Witnesses
Standard-of-care opinions must be grounded in the clinical decision tools and imaging standards that define the workup. A standard-of-care opinion that a reasonable emergency physician should have obtained CT imaging is most defensible when the expert identifies the specific clinical features documented in the record — the right lower quadrant tenderness, the WBC count, the symptom history — and ties the imaging obligation to the Alvarado score thresholds and the ACR Appropriateness Criteria, rather than relying solely on informal gestalt. Defense counsel will challenge any expert who asserts a deviation without identifying the specific clinical decision point where the standard required a different action.
