Despite the availability of validated diagnostic tools, serial ECGs, and high-sensitivity troponin assays, patients continue to be discharged from emergency departments with myocardial infarction misdiagnosed as musculoskeletal chest pain, anxiety, or gastrointestinal upset, only to return hours later in cardiogenic shock or as wrongful death claims.

STEMI vs. NSTEMI: Two Distinct Liability Frameworks
Attorneys handling AMI cases must understand the clinical distinction between ST-elevation myocardial infarction (STEMI) and non-ST-elevation myocardial infarction (NSTEMI), because each triggers a distinct standard-of-care framework with different timing requirements and different liability profiles.
STEMI is the highest-acuity cardiac emergency. It occurs when a coronary artery is completely occluded, producing transmural ischemia visible on ECG as ST-segment elevation in two or more contiguous leads. The ACC/AHA STEMI guidelines establish an ironclad time target: primary percutaneous coronary intervention (PCI) should be performed within 90 minutes of first medical contact at PCI-capable hospitals. When transfer to a PCI-capable center is required, the first-medical-contact-to-device time should not exceed 120 minutes. When PCI cannot be performed within that window, fibrinolytic therapy should be administered within 30 minutes of hospital arrival. Deviations from these benchmarks — particularly in cases where the STEMI was initially missed or misdiagnosed — form the core of most STEMI malpractice claims.
NSTEMI involves partial or transient coronary occlusion, typically without diagnostic ST elevation, and requires risk stratification to guide the timing of intervention. The HEART score and TIMI score are validated clinical decision tools for this purpose. High-risk NSTEMI patients — those with dynamic ECG changes, elevated troponins, hemodynamic instability, or ongoing ischemic symptoms — require an early invasive strategy within two hours under current guidelines. Intermediate-risk patients should undergo invasive evaluation within 24 hours. NSTEMI cases generate liability when these risk-stratification frameworks are bypassed and the patient is sent home or triaged to low-acuity care without appropriate workup.
The ECG: Where Missed Diagnoses Most Often Begin
The 12-lead ECG is the first-line diagnostic tool for suspected AMI and must be obtained and interpreted within 10 minutes of arrival for any patient with chest pain. This 10-minute benchmark is an AHA/ACC standard, and its documentation in the triage record is among the first evidentiary points an expert examines.
Missed STEMI patterns drive a significant proportion of AMI litigation because not all STEMIs present with the textbook finding of obvious ST elevation in anterior or inferior leads. Three patterns in particular account for a disproportionate share of missed diagnoses.
Posterior MI is among the most frequently missed. A posteriorly located infarction produces ST depression in the anterior precordial leads rather than elevation, with tall R waves in leads V1 and V2. Providers who read these changes as nonspecific, or who fail to obtain posterior leads (V7 through V9) in a patient with these findings and a consistent clinical presentation, are missing a treatable STEMI. The posterior lead tracing is an inexpensive and quickly performed diagnostic step; its absence in the record when the anterior lead pattern warranted it is powerful evidence of a protocol failure.
Left bundle branch block (LBBB) obscures standard STEMI criteria. The Sgarbossa criteria — a validated set of ECG findings used to identify AMI superimposed on LBBB — are expected knowledge for emergency physicians. New or presumed-new LBBB in a patient with chest pain is a recognized STEMI equivalent under current guidelines, warranting catheterization laboratory activation. Failure to recognize this pattern, or failure to apply the Sgarbossa criteria in an equivocal LBBB presentation, is a concrete and increasingly litigated deviation from the standard of care.
Subtle or evolving changes in early STEMI may be initially nondiagnostic. The standard of care requires serial ECGs obtained at regular intervals in patients with ongoing symptoms or clinical suspicion. A single ECG that is read as normal and used to justify discharge — without repeat ECGs as symptoms evolve — does not satisfy the diagnostic standard for a patient with high-risk features.
Troponin Testing: Understanding the Protocol and Its Limitations
Troponin elevation is the biochemical hallmark of myocardial injury, but the timing of troponin measurement relative to symptom onset is critical. Conventional troponin assays may not show elevation until three to six hours after symptom onset. A single negative troponin drawn at presentation does not exclude AMI in a patient who presents within two or three hours of symptom onset — and treating it as such is a recurring deviation in emergency department AMI cases.
High-sensitivity troponin (hs-cTn) assays, now in widespread use, allow validated rapid rule-out protocols using serial measurements at presentation and one to two hours later. These accelerated protocols carry specific clinical decision thresholds and must be applied using validated algorithms, not simply a single negative result. The American College of Emergency Physicians has published guidance on the appropriate use of these protocols.
The critical liability point: a provider who obtains a single troponin at presentation, interprets it as negative, and discharges a patient without serial measurement or further evaluation has not followed a complete diagnostic protocol. The standard of care requires serial troponin measurement at three-hour intervals with conventional assays — or application of a validated accelerated protocol with hs-cTn — in combination with clinical and ECG monitoring throughout the observation period. A patient discharged after a single negative troponin within two hours of symptom onset who returns the following day with a completed anterior MI presents a clear and well-supported malpractice framework.
Common Patterns of Negligence in AMI Malpractice Cases
Failure to obtain an ECG within 10 minutes. The timing of the first ECG is documented in the triage record and is among the first evidentiary data points an expert reviews. An ECG obtained 45 or 60 minutes after arrival while alternative diagnoses were pursued, with no documented explanation for the delay, is an early deviation that undermines the defense narrative.
Atypical presentations in women and elderly patients. Clinical research has consistently documented that women, older adults, and patients with diabetes are more likely to present with atypical symptoms — jaw pain, fatigue, dyspnea, nausea, or diaphoresis — without classic substernal chest pressure. Emergency providers are expected to maintain an appropriately lower threshold for cardiac workup in these populations. Anchoring on a non-cardiac diagnosis in an older woman with unexplained dyspnea and diaphoresis, without a cardiac evaluation, is a recognizable and frequently litigated negligence pattern.
Failure to recognize STEMI equivalents. Posterior MI patterns, new LBBB, and the de Winter T-wave pattern are recognized STEMI equivalents that should activate the same catheterization laboratory pathway as classic ST elevation. Missing these on an ECG — or failing to obtain posterior leads when the clinical picture and anterior lead changes warrant it — is a concrete standard-of-care deviation.
Premature discharge without serial monitoring. Patients with chest pain who have not been reliably ruled out should remain under observation with serial ECGs and serial troponins rather than being discharged after a brief evaluation. Many institutions have adopted standardized chest pain observation pathways for intermediate-risk patients. Deviations from these pathways — particularly when the patient decompensates at home within hours of discharge — form the factual foundation of wrongful death claims in this category.
Establishing Causation in AMI Cases
Causation in AMI malpractice is grounded in the quantifiable relationship between ischemia time and myocardial injury. Each minute of coronary occlusion results in progressive cardiomyocyte death, and the extent of myocardial salvage achievable with timely reperfusion decreases predictably with duration of ischemia. This is the physiologic principle underlying both the clinical urgency of the AHA/ACC time benchmarks and the legal framework for causation.
Experts establish causation by reconstructing what the ECG and troponin findings would have shown had the diagnosis been made at the first clinical opportunity, comparing that picture to the patient's state at the time of eventual presentation, and applying the published relationship between total ischemia time and left ventricular function loss. In wrongful death cases, experts compare the patient's presenting hemodynamic status with published mortality data for timely reperfusion — a comparison that frequently supports causation when the patient was hemodynamically stable and a viable interventional candidate at the point of the missed diagnosis.
Defense experts will argue that coronary artery disease and AMI carry inherent mortality regardless of treatment timing. A well-prepared cardiac expert addresses this directly by tying the specific ischemia time delay to quantifiable loss of functional myocardium and by citing the published relationship between door-to-balloon time and mortality at the specific duration of delay documented in the record.

AMI expert testimony is most defensible when the expert is an actively practicing emergency physician, cardiologist, or internist with current experience managing chest pain and acute coronary syndrome in the relevant clinical setting.
