The cases turn on a narrow but consequential set of questions: was the correct nerve targeted at the correct spinal level, was the lesion generated with appropriate technique, and did the physician take the steps required to confirm placement before applying thermal energy. What Radiofrequency Ablation Is and Why Precision Matters

RFA uses a needle-based electrode to deliver targeted thermal energy that disrupts the medial branch nerves responsible for transmitting pain signals from an arthritic facet joint, or in some cases targets other peripheral or sympathetic nerves. The therapy is diagnostic before it is therapeutic: current standards call for the patient to first demonstrate significant, reproducible pain relief from a set of controlled diagnostic medial branch blocks before ablation is performed, since facet-mediated pain cannot be reliably identified by imaging or history alone. A physician who proceeds to ablation without adequate diagnostic block confirmation, or who ablates after an equivocal or single uncontrolled block, has departed from a well-established prerequisite of the procedure — and that departure matters because a patient who never had true facet-mediated pain in the first place cannot benefit from denervation regardless of how well the ablation itself is performed.

Wrong-Level or Wrong-Nerve Treatment

The most frequently litigated RFA complication is treatment at the wrong spinal level or of the wrong nerve target. Correct medial branch localization depends on fluoroscopic identification of specific bony landmarks that vary by spinal segment, and an error in counting vertebral levels, or a failure to obtain adequate anteroposterior and oblique fluoroscopic views before advancing the electrode, can result in ablation of an unintended nerve while the actual pain generator goes untreated. The fluoroscopic images obtained during the procedure, together with the physician's documented verification of level and needle-tip position before each lesion, are the central evidence in a wrong-level case — a chart that shows lesions generated without contemporaneous imaging documentation, or images that on review do not match the level documented in the procedure note, supports a standard-of-care departure independent of whether the patient suffered a permanent injury.

Nerve Injury Beyond the Intended Target

Thermal energy delivered too close to a motor nerve root, the spinal cord, or a nerve root exiting the neural foramen can cause permanent motor weakness, numbness, or neuropathic pain rather than relief. Sensory stimulation testing before lesioning — confirming concordant paresthesia at low-threshold stimulation, and the absence of motor stimulation at a threshold that would indicate proximity to a motor nerve — is the standard safeguard against this complication, and its omission or a failure to respond appropriately to a positive motor stimulation response is a recurring fact pattern. Cervical RFA carries particular risk given the proximity of the vertebral artery and exiting nerve roots, and cases involving cervical-level procedures warrant close scrutiny of the specific technique used to maintain a safe trajectory.

Infection, Bleeding, and Skin Burn

Less common but still litigated complications include epidural or paraspinal infection following inadequate sterile technique, hematoma formation in anticoagulated patients where the procedure proceeded without appropriate medication management, and skin or subcutaneous burns from grounding pad malposition or prolonged lesioning at a single site. Anticoagulation management deserves particular attention: published interventional pain society guidelines classify RFA procedures by bleeding risk and specify recommended anticoagulant and antiplatelet hold times before the procedure, and a documented failure to follow those hold times in a patient who develops a symptomatic hematoma is a straightforward standard-of-care question.

Building the Causation Argument

Causation in RFA litigation requires connecting a specific technical deviation to a specific clinical outcome, and the analysis differs by complication type. In a wrong-level case, the expert must show both that the documented level was incorrect and that a correctly performed procedure at the true target level would more likely than not have provided the patient relief — which typically depends on the diagnostic block results obtained before the ablation was performed. In a nerve injury case, the expert must correlate the anatomic distribution of the patient's new neurologic deficit with the treated level and the physiologically plausible mechanism of injury, distinguishing a genuine procedural injury from the expected, self-limited post-procedure neuritis that resolves within several weeks in a meaningful subset of patients.
