Subarachnoid Hemorrhage Misdiagnosis: What Attorneys Need to Know About Missed SAH Cases
Subarachnoid hemorrhage (SAH) is one of the most consequential diagnostic failures in emergency medicine and neurology. When a ruptured intracranial aneurysm presents as the sudden, catastrophic headache patients describe as the worst pain of their lives, the stakes of sending that patient home with a misdiagnosis are immediate and severe: aneurysmal SAH carries a 30-day mortality of roughly 25–40%, and rebleeding — the outcome that timely diagnosis is designed to prevent — carries its own mortality approaching 57%. Yet studies consistently report that between 12% and 50% of SAH patients are initially misdiagnosed and sent home from emergency departments or outpatient settings. For attorneys evaluating these cases, the clinical and legal framework is well-defined: the two-step diagnostic standard is grounded in professional consensus, the consequences of each hour of delay are quantified in outcome data, and the evidence of deviation is fully documented in timestamped triage notes, CT reports, and lumbar puncture records.
The Presentation Attorneys Need to Understand

Published research consistently places these three diagnoses at the top of the misdiagnosis list, and a recurring liability pattern involves a patient with a prior migraine history whose presenting headache was dramatically different in character and onset from any prior episode — a difference that triage and nursing notes often document but that the treating physician fails to pursue.
The Two-Step Diagnostic Standard
The accepted standard of care for a thunderclap headache is a two-step protocol: non-contrast CT of the head, followed by lumbar puncture if the CT is negative. This standard is not disputed expert opinion — it is reflected in emergency medicine and neurology practice guidelines and is the evidentiary baseline against which every missed SAH case is measured.
### CT Sensitivity and Its Limits
Modern non-contrast CT is highly sensitive for SAH within the first six hours — approximately 98.7% on current multidetector imaging — but that sensitivity declines meaningfully with time. By 24 hours, CT sensitivity for SAH falls to approximately 94.6%. Beyond 24 hours, as subarachnoid blood is progressively diluted and metabolized, sensitivity continues to decline, and a negative CT becomes unreliable on its own. ### Lumbar Puncture and Xanthochromia
When CT is negative, lumbar puncture for xanthochromia — the yellow discoloration of CSF caused by hemoglobin breakdown products — is required for a patient presenting with thunderclap headache. LP should not be performed earlier than two hours after headache onset, because xanthochromia requires time to develop; a sample obtained too early may return falsely negative even in a true hemorrhage.
Spectrophotometry is the gold standard for xanthochromia detection, with sensitivity near 100% and specificity approximately 95% for up to two weeks after SAH. Most United States laboratories rely on visual inspection rather than spectrophotometry, a method with sensitivity of approximately 84%. In cases where a visually inspected specimen was declared negative, expert analysis will consider whether the laboratory's method and its limitations were known to the treating provider and whether the clinical picture warranted additional steps.
When LP yields bloody CSF, distinguishing true hemorrhage from a traumatic tap is itself a standard-of-care requirement. Sequential tube RBC counts — a declining count from tube one to tube four favors traumatic tap — combined with xanthochromia analysis provide this distinction. A chart showing bloody CSF attributed entirely to traumatic tap without xanthochromia assessment, followed by discharge, is a recurring and legally significant pattern in missed SAH litigation.
Rebleeding Risk and the Causation Framework
Rebleeding is the clinical event that turns a misdiagnosed SAH into a catastrophic or fatal outcome, and it anchors causation analysis in most missed SAH cases. Published data show rebleeding occurs in approximately 8–23% of SAH patients within 72 hours of the initial hemorrhage, with ultra-early rebleeding in the first 24 hours accounting for approximately 9–17% of all cases. Rebleed mortality approaches 57%.
Expert analysis reconstructs the timeline from initial presentation to the rebleed: when the patient first arrived, what symptoms were documented, what workup was performed or omitted, when the patient was discharged, and when they returned. A patient who presented with a sudden-onset severe headache, received only CT, was sent home with a migraine diagnosis, and returned hours later in extremis from a second hemorrhage presents a causation framework that is concrete, clock-based, and anchored in well-published outcome data. The records required to build that framework — triage notes with timestamps, CT report with order and read times, LP documentation or its absence, discharge instructions, and EMS records from the return visit — are all routinely available.
Vascular Imaging and Aneurysm Identification
Once SAH is identified, CT angiography (CTA) is the standard first-line study for aneurysm detection, with sensitivity of approximately 85–98% compared to the gold-standard digital subtraction angiography (DSA). CTA sensitivity is meaningfully lower for aneurysms smaller than 3 mm and lesions adjacent to the skull base — an important limitation when a CTA is negative in a confirmed SAH. Cases involving a negative CTA followed by failure to proceed to DSA for definitive aneurysm evaluation can raise a separate standard-of-care question about the completeness of the vascular workup.
Daubert Considerations
The methodology applied to a missed SAH case is well-suited to withstand Daubert scrutiny. CT sensitivity data across time windows is derived from systematic review and meta-analysis of the published literature. The two-step diagnostic protocol is embedded in emergency medicine and neurology society guidelines. Rebleeding rates and their timing are extensively documented in prospective SAH cohort studies. An expert who grounds each opinion in specific records, timestamps, published guideline language, and peer-reviewed outcome data is working within a scientifically rigorous, reproducible methodological framework.
The qualification issue typically turns on whether the expert has active clinical familiarity with SAH evaluation and management — ideally a board-certified vascular neurologist with stroke center practice, an emergency physician with high-volume LP experience, or both.
